The Information Regulator’s decision to take the issue of publishing matric results in newspapers to the Supreme Court of Appeal has been welcomed by some education activists, who believe the move will bring long awaited legal clarity.
The appeal follows a recent Pretoria High Court ruling that dismissed the Regulator’s application to stop newspapers from publishing matric results. The court rejected the argument that the use of examination numbers infringes on learners’ right to privacy, describing the claim as unfounded.
Despite the ruling, the Information Regulator has chosen to pursue the matter further by seeking guidance from the Supreme Court of Appeal on how to balance public access to information with the protection of learners’ personal data.
Call For Legal Certainty
Education activist Hendrick Makaneta has welcomed the decision, saying the appeal process is necessary to provide regulatory certainty. He believes the matter should not be viewed as an attempt to block access to information, but rather as a responsible effort to clarify how the law should be applied.
Makaneta noted that the publication of matric results has long played an important role in helping families access information quickly, particularly in communities with limited internet access. At the same time, he acknowledged that concerns around learner privacy remain valid and should be treated with care.
Striking A Balance Between Access And Privacy
According to Makaneta, seeking judicial guidance is the most appropriate way to strike a balance between transparency and privacy. He said the courts are best placed to provide clarity on how learners’ dignity can be protected while ensuring the public’s right to information is not undermined.
The Supreme Court of Appeal’s decision is expected to set an important precedent that could shape how matric results are published in the future.
Matric Results Dates Confirmed
Meanwhile, the results of the 2025 National Senior Certificate examinations will be announced by the Minister of Basic Education, Siviwe Gwarube, on Monday, 12 January 2026. Candidates will be able to access their individual results from Tuesday, 13 January 2026.
