NPA Holds Off On Prosecution In Emmarentia Shooting Case

The National Prosecuting Authority (NPA) has decided not to proceed with prosecution, for now, against a 58-year-old man arrested in connection with a fatal road rage shooting in Emmarentia, Johannesburg.

The suspect had been due to appear in the Johannesburg Magistrate’s Court on charges of murder and attempted murder following the death of Faisal ul Rehman and the shooting of his wife, Tehseen Rehman.

However, NPA spokesperson Magaboke Mohlatlole confirmed that the case will not be enrolled at this stage, pending further investigation.

The decision follows an assessment of the available evidence, with prosecutors indicating that additional information is required before a final determination on prosecution can be made.

Central to the matter is the suspect’s claim of self-defence. His legal team submitted representations stating that the incident escalated after a collision, during which he was allegedly verbally and physically assaulted.

According to his version, the situation intensified when a firearm was produced and discharged by the couple, prompting him to return fire. The exchange resulted in Rehman’s death and left his wife injured.

Police investigations into the incident are ongoing. South African Police Service (SAPS) has confirmed that the shooting followed a minor collision on Barry Hertzog Avenue that escalated into violence. Cases of murder and attempted murder remain under investigation.

The decision has disappointed the Rehman family, who have indicated their intention to continue pursuing justice.

Authorities have also urged motorists to remain calm and avoid confrontations on the road, warning of the serious risks associated with road rage incidents.

The NPA has reiterated that the matter remains under active investigation and that a decision on prosecution will be made once all relevant evidence has been fully examined.
