Convicted criminal Thabo Bester has claimed that he was on holiday in Tanzania at the time of his arrest in 2023, as he continues to challenge multiple aspects of his detention and prosecution.
Bester appeared in the Johannesburg High Court on 24 March, where he disputed charges linked to his 2022 prison escape from Mangaung Correctional Centre and questioned the legality of his current incarceration.
Representing himself, Bester argued that his original sentence could be found unlawful, claiming this would mean he had been legally released rather than having escaped. He maintained that the circumstances surrounding his departure from prison did not constitute a conventional escape.
He also challenged his classification as a sentenced inmate, stating that being recognised as an awaiting trial prisoner would better enable him to prepare his defence.
In addition, Bester raised concerns about his transfer to the eBongweni Super Maximum Correctional Facility in KwaZulu-Natal, where he said he has been held in solitary confinement for an extended period.
Outside court, Bester appeared unfazed, telling media that he had been on holiday in Tanzania when he was arrested alongside his co-accused, Nandipha Magudumana. He also claimed he could present further evidence to Parliament regarding senior officials.
Bester is facing a range of charges, including those related to his prison escape, defeating the ends of justice and other offences. His trial is currently scheduled to run from 20 July to 18 September 2026 in the Free State High Court in Bloemfontein.
However, several pending legal challenges could delay proceedings. These include disputes over his detention conditions, access to legal resources, and efforts to have his 2023 arrest declared unlawful. He is also seeking access to classified documents and financial resources to support his defence.
Bester’s court appearance also drew attention on social media, where his choice of attire, including a designer Louis Vuitton shirt, became a talking point.
The case remains one of the country’s most closely watched, as legal proceedings continue to unfold.
