Gareth Mnisi has been granted an additional seven days to submit written reasons explaining why he should not be placed on precautionary suspension.
The embattled Chief Financial Officer of the City of Tshwane Municipality has been implicated in allegations of tender irregularities currently under scrutiny at the Madlanga Commission.
Evidence presented at the commission, including subpoenaed WhatsApp messages, suggests Mnisi may have been involved in discussions around tender processes and invoice matters alongside other officials. At the time, he chaired the municipality’s Bid Adjudication Committee, which plays a central role in awarding contracts.
Despite being absent from work in recent weeks, Mnisi has not yet been formally suspended.
Council Considers Next Steps
The Tshwane council recently held a closed-door meeting to deliberate on a confidential report regarding Mnisi’s potential suspension.
A prior resolution gave him seven days to make written submissions after being served with a notice of possible precautionary suspension.
Legal Challenge From Mnisi’s Team
Mnisi’s legal representatives have challenged the process, arguing that the notice lacks sufficient detail about the allegations against him. They contend that without clear charges, he cannot adequately respond or defend himself.
The legal team has also questioned whether proper procedures were followed, including whether there is justification for removing him from the workplace.
City Stands By Process
The municipality has rejected these claims, maintaining that the notice complies with labour regulations. Officials argue that the allegations are serious and that allowing Mnisi to return to his role could risk interference with the investigation and further compromise procurement processes.
City management has emphasised that the matter has already impacted the municipality’s reputation and could affect investor confidence.
Mnisi has now been given until 11 April to submit his response, with the council endorsing the extended deadline.
Madlanga Commission Appearance Pending
Mnisi is expected to appear before the Madlanga Commission on 17 April, where his testimony is anticipated to provide further clarity on the allegations.
