JOHANNESBURG – National Director of Public Prosecutions Shaun Abrahams will now have to decide whether to withdraw charges against Finance Minister Pravin Gordhan after receiving an invitation from his legal team to do so.
Yesterday, Gordhan’s lawyers told Abrahams they will not be making representations to him on the fraud charges levelled against the minister.
Abrahams had invited Gordhan to make representations after he met with the lawyers for former Sars commissioners Ivan Pillay and Oupa Magashula, who were also charged.
He will now have to look at submissions made by lawyers for Pillay and Magashula and decide whether or not to withdraw fraud charges.
If he does decide to withdraw, he could be criticised for back-peddling on an unpopular prosecution.
However, he could argue the decision shows he is his own man, who is willing to show his independence by reviewing a decision made by one of his prosecutors.
