Inside the Legal Chess Game: Mkhwanazi Versus Mathibeli

Durban – A high-stakes legal battle is unfolding between KwaZulu-Natal Police Commissioner Lieutenant-General Nhlanhla Mkhwanazi and Durban businessman Calvin Mojalefa Mathibeli, after explosive allegations triggered urgent court action and threats of further litigation.

Mkhwanazi has filed an urgent application in the High Court in Durban seeking to interdict Mathibeli from repeating claims that the commissioner says are defamatory and harmful to his reputation. The businessman had publicly alleged that there was a plot to have him killed and suggested that senior police figures were implicated. Mkhwanazi has strongly denied the accusations.

In court papers, the provincial commissioner argues that the continued publication of the statements on social media platforms has caused reputational damage and undermines public confidence in the police service. He is seeking an order to compel Mathibeli to remove the posts and refrain from making further allegations pending the finalisation of the matter.

The dispute has escalated rapidly, with KwaZulu-Natal police warning that they would not tolerate what they described as reckless and malicious claims. The standoff has drawn national attention, given Mkhwanazi’s position as the top law enforcement official in the province and the seriousness of the allegations involved.

Legal analysts say the case may hinge on the balance between freedom of expression and the protection of dignity and reputation, particularly when allegations are directed at public officials. The matter is expected to proceed before the Durban High Court in the coming days as both parties prepare to argue their positions.
