The City of Tshwane could lose an anticipated R540 million in revenue after the Pretoria High Court dismissed its application for leave to appeal against the scrapping of its city cleansing levy.
Earlier this month, the court ruled in favour of lobby group AfriForum, declaring the municipality’s R194 monthly charge unlawful.
The levy had been introduced to target around 250,000 households and businesses that rely on private waste collectors, with the city projecting an annual income of more than half a billion rand.
Following Monday’s ruling, municipal spokesperson Selby Bokaba said the city would consult senior legal counsel to assess the implications and consider its next steps. Tshwane has one month to decide whether to pursue another appeal.
In its initial judgment, the court also ordered the city to reimburse customers who had already been billed for the levy, compounding the financial setback for the cash-strapped municipality.
