Former Public Protector Busisiwe Mkhwebane will not receive her R10 million gratuity, following a ruling by the Gauteng High Court in Pretoria on Wednesday.
Mkhwebane had approached the court to compel the Office of the Public Protector to release the funds.
Back in August, Pretoria News reported that Mkhwebane’s claim had no legal basis, as she was removed from office before her term ended.
Advocate Tembeka Ngcukaitobi, representing the Public Protector’s office, also noted that Mkhwebane had not resigned from her position, which further invalidated her claim.
Mkhwebane became the first head of a Chapter 9 institution to be impeached. She recently attracted criticism after her appeal in the Supreme Court of Appeal was dismissed, with the court ordering her to cover the costs.
In a controversial outburst, Mkhwebane accused individuals, “predominantly of Indian descent,” of persecuting her.
Parliament strongly condemned her remarks, emphasising that her accusations against legal advisers, who have served with integrity, were baseless.
Parliamentary spokesperson Moloto Mothapo expressed disappointment, stating that Mkhwebane’s racial comments were unacceptable in a democracy that values human dignity.
He further highlighted Mkhwebane’s duty as a Member of Parliament to uphold constitutional values that form the foundation of the country’s democracy.
